Draft UK-EU Comprehensive Free Trade Agreement - published by HM Government - May 2020

HM Government has published a range of draft legal texts, including a draft UK-EU comprehensive free trade agreement (CFTA), setting out its proposed approach to the UK and EU’s future relationship post-Brexit. This follows HM Government’s policy paper outlining its approach to negotiations, which was published in February 2020. HM Government states that the draft legal texts represent the legal articulation of its approach in the policy paper, and that these have already formed the basis of discussions with the EU. The EU published its approach to the future relationship between the UK and EU in March 2020.

The UK’s proposed future relationship with the EU focuses on a draft UK-EU CFTA accompanied by additional agreements covering areas such as fisheries, law enforcement and judicial co-operation in criminal matters, civil aviation safety and energy. This contrasts with the EU’s position, which envisages an overall governance framework, covering all areas of economic and security co-operation. HM Government states that the draft UK-EU CFTA draws on existing EU agreements, is consistent with the political declaration and provides for zero tariffs and zero quotas on goods.

Financial services-related proposals are contained in Chapter 17 and, among other things, cover: (i) the treatment of cross-border financial services suppliers; (ii) payments and clearing; (iii) the recognition of prudential measures; (iv) senior management and board functions; and (v) regulatory co-operation.
