Data-driven regulation and supervision - ESMA publishes speech by Executive Director - 8 October 2021

The European Securities and Markets Authority (ESMA) has published a speech by its Executive Director, Natasha Cazenave, entitled ‘ESMA as a data driven regulator and supervisor’. In the speech Ms Cazenave summarises three key projects for 2022: the Capital Markets Union; the Sustainable Finance agenda; and the Digital Finance package. She also notes that ESMA will become the supervisory body for critical benchmark administrators and data reporting service providers from January 2022.

Ms Cazenave goes on to mention the ways in which ESMA collects and uses data, and uses or is considering the use of new technologies (for example, blockchain and distributed ledger technology). In her concluding remarks, she notes ESMA’s focus on standardising data reporting, streamlining existing processes and ensuring high standards of transparency, while reducing firms’ reporting burdens.

Securitisation Regulation - ESMA publishes final report for STS synthetic securitisation notifications - 12 October 2021

ESMA has published its final report on draft regulatory technical standards (RTS) on the content and format of simple, transparent and standardised (STS) notifications under the amended Securitisation Regulation (EU) 2017/2402. The RTS specify the information that the originator, sponsor and Securitisation Special Purpose Entity (SSPE) are required to provide in order to comply with the STS notification requirements for synthetic securitisations. They also contain amendments to the STS notification requirements for traditional securitisations, in order to ensure consistency between the two STS notification regimes.

The draft RTS have been submitted to the European Commission for endorsement. In the meantime, originators can make the necessary information available to ESMA by using the interim STS synthetic notification templates.
